Contacted by council offering to settle claim
I was injured on a council-owned site when I put my foot through a wooden board and broke my ankle which I am still having treatment on. A very nice man from the council called yesterday and told me it could take years to settle and would I accept a cheque for £1,000 as full and final settlement without their admitting liability. I am a bit short of cash as I have been unable to work and I am self employed. What should I do?
You should always get advice before:
- contacting the person or organisation you think caused the injury (though you should tell your employer at once if you were injured at work)
- replying to any letters or offers to settle your claim.
In a case such as this the offer is a massive under-settlement especially in view of your loss of earnings. Have you considered the ongoing pain and suffering you have suffered (and continue to suffer)? How long will it be before you can go back to work?
Although the council offer is not an admission of liability the offer of cash suggests they know they are responsible and on the face of it liability seems clear cut.
